Heard the learned counsel for the petitioner and learned APP for the State.
This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 8/20/(b) (ii)/(C)/23/25C of the NDPS Act, registered in connection with C-2/05/2019(Trial No.13/2020).
The learned counsel for the petitioner has submitted that he is a person of clean antecedent and is languishing in jail
Patna High Court CR. MISC. No.51399 of 2022(7) dt.26-04-2023 2/2 for more than three and half years for the allegation that 10.5 kg of charas like substance was recovered from his possession. A report was called for from the court below about the stage of the trial which has been received, showing that the charges have been framed on 11.04.2023 and the record is running at the evidence stage.
In view of aforesaid, the learned trial court is directed to make every endeavour to dispose of the trial within a period of six months.
If the trial is not concluded within the stipulated period, the petitioner may renew his prayer for bail in the trial court itself.
With these observations, the application stands disposed of.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
