JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 25(1-B)A, 26 (1) and 35 of the Arms Act. The first information report goes to show that the petitioner was neither caught on the spot nor anything was recovered from his conscious possession and the name of the petitioner was disclosed by co-accused Binda Devi who was caught with illegal firearms.

Petitioner is in jail custody since 24.5.2018 and does not have any criminal antecedent which is evident from para 3 of the petition.

Patna High Court Cr.Misc. No.43489 of 2018 (2) dt.19-07-2018 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Railway, Bhagalpur in Bhagalpur Rail P.S. Case no. 06/2018.
