JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 22.5.2018 seeks bail in Sanjhauli PS Case No. 51 of 2018 registered under Section 394 of the IPC.

The allegation in brief is that some unknown miscreants tried to rob the informant while he was coming on motorcycle and one of them shot at them causing injury to the pillion rider but they reached and thereafter lodged the case.

Learned Counsel for the petitioner submits that only on the basis of confessional statement of one Sugandh Yadav he has been made accused in this case and later on the police has recorded confessional statement in his name but no other incriminating material has been recovered showing his involvement in the present case and the petitioner has one criminal antecedent in which case he is on bail.

Having considered the said facts and circumstances, the petitioner, namely, Nitesh Pandey is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM

Patna High Court Cr.Misc. No.45302 of 2018 (2) dt.27-07-2018 Bikramganj (Rohtas) in connection with Sanjhauli PS Case No. 51 of 2018 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner.

(ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
