The petitioner is in custody since 23.01.2018, in connection with Jalalgarh P.S. Case No. 05 of 2018, for the offence registered under Sections 302, 120B and 34 of the I.P.C. Learned counsel for the petitioner submits that initially she was the informant of the case, but on the basis of confessional statement made before the police by one Umanand Mandal, the petitioner has been taken into custody as being one of the conspirators of the murder of her husband. It is further submitted that the said Umanand Mandal who is the main accused in this case since been granted privilege of bail by this Court in Cr. Misc. No. 23662 of 2018 vide order dated 25.04.2018.

Patna High Court Cr.Misc. No.45848 of 2018(2) dt.16-08-2018 2/2 Learned counsel for the petitioner submits that on the basis of confessional statement made before the police, the petitioner may not be prosecuted and the same has no evidentiary value.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia, in connection with Jalalgarh P.S. Case No. 05 of 2018.
