JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code. The prosecution case is that the complainant handed over Rs. 1,60,000/- to the co-accused Mansur Alam and others for depositing in a non-banking financial company. It is alleged against the petitioners and others that they facilitated the said deposit but the co-accused Mansur Alam supplied receipt of Rs. 80,000/- and the rest amount was misappropriated.
It is submitted by learned counsel for the petitioners that admittedly the money was entrusted to Mansur Alam and there is noting on record to suggest that petitioners were entrusted with the said non-banking financial company.
Patna High Court Cr.Misc. No.23626 of 2016 (2) dt.26-05-2016 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Patna in connection with Complaint Case No. 447(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
