The petitioner seeks bail in anticipation of his arrest in connection with Khodawanpur (Chhaurahi O.P.) P.S. Case No. 145 of 2019 instituted for the offences under Sections 272, 273 and 120B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. 1833.12 litres of liquor is said to have been recovered from a vehicle. One Rambabu Singh was arrested

Patna High Court CR. MISC. No.8430 of 2021(2) dt.17-12-2021 2/3 on suspicion who has disclosed the name of the petitioner and others as persons who also were indulging in sale and purchase of liquor.

The learned counsel for the petitioner has submitted that beyond confession of aforesaid Rambabu Singh, there is no other material to connect the petitioner with the offence.

He does not have criminal antecedents.

On these two grounds, it has been urged that no offence under the Excise Act cannot be said to have been made out as against the petitioner.

For the reasons afore-stated, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, Excise Act, Begusarai, in connection with Khodawanpur (Chhaurahi O.P.)
