JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 420, 379 of the IPC and 66 of the IT Act. The petitioner is named in the first information report with allegation that Rs 40,000/- was deposited in his account on 4.10.2017.

Written report of the informant goes to show that Rs 1,20,000/- was withdrawn from her account on 3.10.2017 and 4.10.2017 and subsequently, Rs 40,000/- was deposited in the account of the petitioner. So far as remaining amount is concerned, the same has not been recovered from possession of the petitioner.

Patna High Court Cr.Misc. No.43453 of 2018 (2) dt.19-07-2018 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the ACJM-cum- Sub Judge VIII, Saran at Chapra in Bhagwan Bazar P.S. Case no. 382/2017.
