The petitioner seeks bail in Rafiganj P. S. Case No. 80 of 2019 instituted for the offence under Section 379 of the Indian Penal Code.

Learned counsel for petitioner submits that FIR is against unknown. No TIP has been held. Petitoner has been arrested merely on suspicion.

It has come in para 35 of the case diary that during investigation police found two boys standing near one black colour splendor motorcycle and were talking. On interrogation, they could not produce the paper of the aforesaid motorcycle. The police has found the same motorcycle which is subject matter of this case.

The petitioner is in custody since 10.6.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Aurangabad, in connection with Rafiganj P. S. Case No. 80 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
