JUSTICE ARUN KUMAR ORAL ORDER 20-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.5.2018, seeks bail in Kotwali PS Case No. 263 of 2018 registered under Sections 365, 386 and 120B of the IPC.

The allegation in brief is that the informant had some relationship with the petitioner in connection with business and it is alleged that the petitioner had given 1.5 lakh rupees to Navin Kumar and fifty thousand rupees was transferred by the petitioner in the account of the informant, later on the same was withdrawn by Navin Kumar through ATM and it is alleged that one day the petitioner brought him to his residence and forcefully asked him to sign on a blank stamp paper, later on agreement of Rs. 1.5 lakh was created and the petitioner confined him in his house for 16 days and used to ask him to give money and also used to assault him, the police recovered the informant from the house of the petitioner. Learned Counsel for the petitioner submits that there was some dispute with regard to business in between the petitioner and the informant and on account of that the petitioner has falsely been implicated in this case, he has no criminal antecedent and has been in custody for more than three months.

Patna High Court Cr.Misc. No.44072 of 2018 (2) dt.20-07-2018 Having considered the said facts and circumstances, the petitioner, namely, Arun Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Patna in connection with Kotwali PS Case No. 263 of 2018.
