Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 427, 547, 379, 380, 504 of the Indian Penal Code.
It is alleged that the petitioner was seen committing theft in the shop of the informant and it was found that Rs. 18,000/- was taken away from the box kept in the shop of the informant.
It is submitted by the learned counsel for the petitioner that since the Harichadra Das one of the accused lodged Baligaon P.S. Case No. 79 of 2012 under Sections 307/34 of the Indian Penal Code against the informant on 20.11.2012 hence, in retaliation this case was registered on
Patna High Court Cr.Misc. No.10006 of 2015 (2) dt.22-04-2015 23.11.2012. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Baligaon P.S. Case No. 89 of 2012, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur.
With this observation this application is disposed of.
