JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 This application, for grant of anticipatory bail, arises out of Kartahan P.S. Case No. 74/18, disclosing offences under Sections 120 (B)/304(B)/34 of the Indian Penal Code. Petitioners happen to be father in law and mother in law of the deceased and allegation against them and others is of causing death of the deceased for non fulfilment of demand of dowry.

Submission of learned counsel for the petitioners is that they are father in law and mother in law of the deceased and have falsely been made accused in this case and the real fact is that as her husband was working outside and was not taking her

Patna High Court CR. MISC. No.48778 of 2019(3) dt.16-11-2019 2/2 with himself, due to which, she committed suicide. Moreover, no specific allegation has been attributed to the petitioners. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Hajipur, Vaishali, in connection with Kartahan P.S. Case No. 74/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
