JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-05-2022 At the very outset, learned counsel for the petitioners seeks permission to withdraw the petition in respect of petitioner nos.3, 4, 5, 6, 8, 9, 10 and 11 above named.

Patna High Court CR. MISC. No.62416 of 2021(2) dt.18-05-2022 2/3 Permission is accorded.

Accordingly, the petition of petitioner nos.3, 4, 5, 6, 8, 9, 10 and 11 is dismissed as withdrawn.

Heard learned counsel for the petitioner nos.1, 2 and 7 and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 143, 188, 269, 270, 341, 323, 307 and 353 of the Indian Penal Code.

It is a case of creating hindrance in discharge of the official duties of the police.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that specific allegation of assault is against petitioner no.3 Dinesh Sharma who wrapped the Gamcha around the neck of Chaukidar Mahendra Sharma and not these petitioners. Petitioner nos.1, 2 and 7 have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, namely, Radha Devi, Yasoda Devi @ Yashodha Devi and Bahadur Sharma, in the event of their arrest or surrender

Patna High Court CR. MISC. No.62416 of 2021(2) dt.18-05-2022 3/3 before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Birpur, District- Supaul in connection with Raghopur P.S. Case No. 126 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
