The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379/411/34 of the Indian Penal Code.
It is alleged that on theft of 2 H.P. Kirloskar motor pump of the informant, the FIR was lodged against four accused persons including the petitioner. Subsequently, the stolen motorcycle was recovered from the house of the petitioner on the confession of co-accused Nepali Yadav.
It is submitted by learned counsel for the petitioner that there is no specific allegation against the petitioner and the seizure has not been made from the petitioner. The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.15102 of 2015 (2) dt.13-05-2015 2/2 consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Konch P.S. Case No. 95 of 2014, pending before learned Judicial Magistrate, 1st Class, Gaya.
With the above observation, this application is, accordingly, disposed off.
