The petitioner apprehends his arrest in Sheikhpura P.S. Case No. 129/2013, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and Section 138 of Negotiable Instruments Act.

The gist of the allegation is that the petitioner took Rs. 1,27,000/- from the informant and issued a cheque in favour of the informant when informant deposited the cheque in the bank the cheque was dishonoured.

It is submitted that the petitioner is ready to pay the entire amount in three equal monthly installments.

No.20746 of 2016 (2) dt.19-05-2016 2/2 Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 129/2013, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

If the petitioner fails to pay the entire amount i.e., Rs. 1,27,000/- through draft within three months in three equal installments the learned court below shall cancel the bail bond of the petitioner.
