Petitioner, already in custody, seeks bail in connection with Barbigha P.S. Case No.579 of 2017, registered under Sections 341, 323, 307 and 387/34 of the Indian Penal Code as well as under Sections 27 and 37(b) of the Arms Act. Learned counsel for the petitioner submits that earlier the prayer of bail of the petitioner was rejected by order dated 08.03.2018, passed in Cr. Misc. No.2737 of 2018 giving liberty to renew the prayer of bail after framing of the charge and the trial court by order dated 05.07.2018 has framed the charge against the petitioner and the petitioner has been in custody since 26.11.2017.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.44865 of 2018(2) dt.01-08-2018 2/2 circumstances, petitioner Gopal Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Sheikhpura in connection with Barbigha P.S. Case No.579 of 2017, giving rise to Sessions Trial No.65 of 2018.
