JUSTICE SATYAVRAT VERMA ORAL ORDER 04-07-2023 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the complainant. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 498(A) of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner no. 1 being the husband of the complainant has been falsely implicated in the present case. It is further submitted that the matter was referred for mediation and from perusal of the report of the learned Mediator, it would manifest that the issue between the petitioner no. 1 and the complainant has been

Learned counsel for the complainant does not rebut the submission of the learned counsel for the petitioners but then submits that some conditions be imposed while granting bail. The Court does not feel persuaded by the submission of the learned counsel for the complainant as the learned Mediator in detail has recorded the terms of the mediation. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 2175 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
