JUSTICE PARTHA SARTHY ORAL ORDER 31-05-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Ahiyapur P.S Case no. 413 of 2020 (N.D.P.S. Case no. 30 of 2020) registered under sections 20 and 22 of the N.D.P.S. Act.

As per allegation in the F.I.R., on seeing the three accused including the petitioner herein in a suspicious condition, it is stated by the informant that they were questioned and on search 500 grams each of Ganja was recovered from the three accused persons including the petitioner herein. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession and he has been falsely implicated in the case

Patna High Court CR. MISC. No.8340 of 2021(2) dt.31-05-2021 2/2 because of his antecedent. There is violation of various provisions of the N.D.P.S. Act in connection with search and seizure. The petitioner is in custody since 9.5.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody for more than one year, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Ahiyapur P.S. Case No. 413 of 2020 (N.D.P.S. Case No. 30 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions V- cum - Special Judge, N.D.P.S., Muzaffarpur.
