ANJANA MISHRA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners, being the family members of the husband of the deceased lady, have been made accused persons in a case under Section 304B of the I.P.C., and are apprehending their arrest in connection with Mirganj P.S. Case No.206 of 2014.

Learned counsel for the petitioners submits that the allegation against these petitioners is general and omnibus and save and except the said allegation, there is no other cogent evidence in the case diary to connect them with the occurrence. Learned counsel for the State submits that case diary

Patna High Court Cr.Misc. No.10394 of 2015 (4) dt.23-07-2015 2/2 has also been received, but he could not point out anything special which has come in the case diary.

Considering the present facts and circumstances and that the husband of the deceased lady is already in custody, let all the four petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No.206 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
