2. Petitioner is in custody in connection with Bhairavsthan P.S. Case No. 95 of 2026 registered for the offenses punishable under Section 274, 275, 3(5) of BNS and 30(a) of Bihar Prohibition and Excise Amendment Act, 2022.

3. As per allegation in the FIR, a total of 324 liter of Nepali country made liquor and 108 liter of cane beer were recovered from the back seat of a Scorpio Car. It has been alleged that the other co-accused person fled from the spot. It has further been alleged that the petitioner is the driver and not owner of the said vehicle.

4. Learned counsel for the petitioner submits that the

He further submits the petitioner was neither apprehended from the spot nor was any incriminating article recovered from his conscious possession. It is further submitted that the petitioner is neither the owner nor the driver of the alleged vehicle. It has lastly been submitted that the petitioner is in custody since 09.06.2026 and he has no criminal antecedent.

5. Learned APP appearing on behalf of the State vehemently oppose the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and also submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Jhanjharpur, Madhubani, in connection with Bhairavsthan P.S.
