Learned counsel for the respondent Bank submits that the petitioner has defaulted in loan re-payments and as such action under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 as well as certificate proceedings have been taken against the petitioner which are legal and valid in view of section 37 of the SARFAESI Act.
