Petitioner apprehends his arrest in connection with Complaint Case No. 922/2013 in which offences punishable under sections 341, 323, 379, 504/34 of the IPC and section 3/4 of the Prevention of witch Practices Act, 1999, prima facie, found true against the petitioner.

The contention on behalf of the petitioner is that the complainant has brought this false case in retaliation to Singheshwar P.S. Case no. 112/2013 which was lodged on the statement of petitioner against complainant and her other family members and furthermore, in Singheshwar P.S. Case no. 112/2013, petitioner and his other family members sustained injury.

Considering the aforesaid facts and circumstances as well as

No.6953 of 2015 (2) dt.23-02-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in Complaint Case No. 922/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
