JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kateya P.S. Case No. 145 of 2012 registered for the offence punishable under Section 394 of the Indian Penal Code. Petitioner was not caught on the spot and his name was disclosed by co-accused who was apprehended on the spot at the time of alleged occurrence.

The contention on behalf of the petitioner is that coaccused, Nazir Mian having similar allegation got anticipatory bail by the court below itself on 19.09.2014 vide A.B.P. No. 1223 of 2014 but the prayer for anticipatory bail of the petitioner was rejected by the learned Sessions Judge, Gopalganj. Considering the aforesaid facts and circumstances as

No.7530 of 2015 (2) dt.26-02-2015 well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. Ranjan, Judicial Magistrate 1st Class, Gopalganj in Kateya P.S. Case No. 145 of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
