The petitioner seeks bail in connection with Beur P.S. Case No. 192 of 2019, registered under Sections 304(B) and 307/34 of the Indian Penal Code.

The accusation is that informant Upendar Singh performed the marriage of his daughter in the year 2011 with Amit Kumar, son of the petitioner, while his daughter was kept properly in her matrimonial house, for few months, but, after that she was being tortured due to non-fulfillment of demand of dowry. In the meantime, she blessed with two children, but his daughter was killed due to non-fulfillment of demand of cash of Rs. One lakh.

Learned counsel for the petitioner submits that,

No.48176 of 2019(3) dt.04-12-2019 2/2 admittedly, the petitioner is father-in-law of the deceased, daughter of the informant, and petitioner along with Amit Kumar, husband of the deceased, is in custody since 30.05.2019. Further submission is that Aditi Kumari, daughter of the deceased, gave her statement saying that her mummy inflicted injury to her. Further submission is that while Chargesheet has been submitted under Section 304(B) of the Indian Penal Code, but it would appear from the F.I.R. that the alleged occurrence took place after seven years of marriage of the deceased. The petitioner has no criminal antecedent. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VIII, Patna in connection with Beur P.S. Case No. 192 of 2019.
