JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420/34 of the Indian Penal Code.

It is alleged that on the recommendation of the petitioner, the complainant gave Rs.16000/- to one Subhash Mistry brother of the petitioner to deposit the said amount in the Reliance Life Insurance Co. but somehow the complainant found that it was not deposited. Subsequently, when the complainant demanded the said money, the non-petitioner assaulted and dragged her to outrage her modesty. It is submitted by learned counsel for the petitioners that the specific accusation is against Subhash Mistry not against this petitioner. Considering the nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or
