Petitioner has prayed for the following relief(s): - "For issuance of an appropriate writ in the nature of Certiorari for quashing of the order dated 11.09.2020 passed by the Collector cum District Magistrate, Khagaria, in a Confiscation Case No. 403A/2019-20 and further for release of Mahindra Scorpio Four Wheeler vehicle bearing Registration No. BR-34P-4393 owned by the petitioner."

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file an appeal.

Patna High Court CWJC No.2007 of 2021 dt.09-03-2021 2/2 Petitioner has approached this Court without availing the statutory remedy of appeal against the impugned order, as such, liberty is granted to petitioner to file an appeal against the confiscation order before the appellate authority and if any appeal is filed within 60 days then appellate authority shall condone the delay in filing appeal, as the matter remained pending before this Court, and shall decide the appeal preferably within 60 days from the date of its filing.

With aforesaid liberty, the writ petition is disposed of as withdrawn.
