The petitioner has been in custody since 24.05.2018 in connection with Pakribarawan P.S. Case No. 90/18 registered for the offences punishable under Sections 147/149/307/341/323 of the Indian Penal Code.
Learned counsel for the petitioner submits that the entire occurrence took place on account of a land dispute and they had all consumed toddy which resulted in a free fight. It is submitted that the allegations are general and omnibus in nature and no specific role has been attributed to the present petitioner. It is further submitted that other co-accused persons have since been extended the privilege of bail vide order dated 19.07.2018 passed
Patna High Court Cr.Misc. No.42475 of 2018 (3) dt.26-07-2018 2/2 in Cr. Misc. No. 36062 of 2018.
Learned counsel appearing on behalf of the informant submits that the injury No. 2 has been found to be grievous in nature.
Considering the aforementioned facts and circumstances and that the petitioner is having a clean antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada, in connection with Pakribarawan P.S. Case No. 90/2018.
