1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

3. In the nature of allegation as alleged in the FIR, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner as it has been submitted by the learned APP, Mr. Chandra Bhushan Prasad, that codeine also comes under the NDPS Act and it appears that the FIR has only been instituted under the Excise Act.

4. Accordingly, the instant anticipatory bail application stands rejected.
