The petitioner apprehends arrest in connection with Raniganj P.S. Case No. 207 of 2014 registered under section 498-A of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the informant Pratibha Devi and he is still ready to keep her with full honour and dignity. It is also submitted that the petitioner has filed Matrimonial Case No. 198 of 2012 for restitution of conjugal
Patna High Court Cr.Misc. No.12976 of 2015 (2) dt.01-06-2015 right.
Learned counsel for the informant submits that the informant is also ready to lead conjugal life with the petitioner. Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within four weeks, be enlarged on provisional bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Singh, Judicial Magistrate, 1st Class, Araria in connection with Raniganj P.S. Case No. 207 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. Learned trial court is directed to issue notice to the informant Pratibha Devi and make attempt to resolve the dispute in between the petitioner and the informant Pratibha Devi by taking all possible efforts and if the dispute is resolved the trial court shall confirm the provisional bail of the petitioner. If the dispute is not resolved, then the trial court will pass order on its own merit.
