JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.
The prosecution case is that the police during vehicle check intercepted two persons driving on motorcycle when the pillion driver escaped from the scene and the driver was apprehended who suggested the name of the petitioner as pillion driver.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that motorcycle is stolen one. Moreover the recovery is not from the possession of the petitioner.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Ara
Patna High Court Cr.Misc. No.23203 of 2016 (2) dt.24-05-2016 2/2 Nawada P.S. Case No. 264 of 2016, pending in the Court of learned Chief Judicial Magistrate, Bhojpur at Ara. With the observations above, the application stands disposed off.
