JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 35 of 2014 registered for the offence under Sections-363, 364/34 of the Indian Penal Code. The statement of the victim, recorded u/S 164 of the Code of Criminal Procedure reflects that she was in love with the petitioner and subsequently, she eloped with the petitioner and solemnized her marriage with him. The age of the victim was assessed by the learned Magistrate as 13 years whereas; the victim has disclosed her age as 19 years.

Taking into consideration the aforesaid facts and

Patna High Court Cr.Misc. No.8843 of 2015 (2) dt.04-03-2015 2/2 circumstances as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sugauli P.S. Case No. 35 of 2014 to the satisfaction of Additional Chief Judicial Magistrate, East Champaran at Motihari subject to conditions as laid down u/S 438(2) of the Cr. P.C.
