JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 34 of the Indian Penal Code. The prosecution case is that five F.I.R named accused persons including the petitioner assaulted the brother of the informant when co-accused Bidyapati Bind snatched Rs. 2000/- from the pocket of the brother of the informant. It is submitted by learned counsel for the petitioner that accusation of assault is against five persons but one head injury was found for which the opinion has been kept reserved. The other injury of the abrasion has been found to be simple in nature. For the occurrence of 08.03.2016 the F.I.R was registered on 10.03.2016. There is counter version of the occurrence also.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.23181 of 2016 (2) dt.24-05-2016 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Ghosi(Okari) P.S. Case No. 64 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
