JUSTICE ARUN KUMAR ORAL ORDER 30-07-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State.

Petitioner, already in custody since 9.5.2018, seeks bail in Laheri PS Case No. 116 of 2018, registered under Sections 461, 379 and 411 of the IPC.

The allegation in brief is that the petitioner was employee in the business premises of the informant and used to steal seeds and pesticide and used to sell it to another shop-keeper Pramod Kumar. Learned Counsel for the petitioner submits that Pramod Kumar, another co-accused, from whose possession recovery is alleged to have been made, was granted bail earlier by a coordinate Bench of this Court considering the fact that he had shown papers relating to purchase of those pesticides.

Whereas learned Counsel appearing on behalf of the informant opposed the prayer for bail.

Having considered the said facts and circumstances, the petitioner Sudhir Kumar is directed to be released on bail on

Patna High Court Cr.Misc. No.45603 of 2018 (2) dt.30-07-2018 furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Biharsharif, Nalanda in connection with Laheri PS Case No. 116 of 2018.
