JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 24-05-2016 The petitioner apprehends his arrest in relation to Tajpur P.S. Case No. 134 of 2015 registered under Sections 363, 366(A), 372/34 of the Indian Penal Code.
Attention of the Court is drawn towards the FIR that there is suspicion as against the petitioner being involved in the kidnapping. The learned Sessions Judge, Samastipur has clearly noted in his order, after perusing the case diary the factum of kidnapping of the minor daughter of the informant is supported by the witnesses but the fact that the petitioner or any other named person in the F.I.R. was involved in the kidnapping, has not been initiated, except by the suspicion of the informant. Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner above
Patna High Court Cr.Misc. No.22416 of 2016 (2) dt.24-05-2016 2/2 named be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur, in connection with Tajpur P.S. Case No. 134 of 2015, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure.
