====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-12-2021 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30 (A) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Allegation against the petitioner is of recovery of total 9.360 liters of illicit liquor from hut in the side of the house of the petitioner.

It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. The said hut does not belong to the petitioner. There is no recovery from the conscious possession of the petitioner. The petitioner has got no criminal antecedent, which is mentioned in para 3 of the bail application.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court, in connection with Chainpur P.S. Case No. 336/2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Sunil Kumar Panwar, J) amitkumar/- U T
