JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-04-2021 Heard Mr. Shankar Kumar, learned counsel for the petitioner and Mr. Surendra Prasad Singh, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with C2 Case No. 324 of 2020 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation as per the First Information Report is that S.S.B. personnel arrested the petitioner along with 94.5 liters of illicit liquor near the Indo-Nepal Border. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated by S.S.B. personnel due to oblique motive. Learned counsel next submits that the illicit liquor in question has not been recovered from the conscious possession of the petitioner as would be evident from the seizure list prepared by S.S.B. personnel. Having regard to the submissions made by learned counsel for the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 28.08.2020 and prosecution report / investigation report has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge Excise Act Sitamarhi in connection with C2 Case No. 324 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
