JUSTICE MIHIR KUMAR JHA ORAL ORDER 24-03-2015 Learned counsel for the petitioner prays for and is allowed to implead Life Insurance Corporation of India through the Divisional Manager, Patna as respondent no.5. Heard learned counsel for the parties.

Having regard to the fact that the petitioner has only the grievance with regard to non-payment of amount of group insurance of her husband, who was employee of the Central Bank of India and had died in harness on 20.6.2005, this Court in keeping with the communication dated 25.1.2013 that the amount of group insurance of her husband (late Ram Karan Nayak) was pending consideration before the authorities of the Life Insurance Corporation of India and the correspondence from the L.I.C. was

Patna High Court CWJC No.3998 of 2015 (2) dt.24-03-2015 still going on would direct both the authorities of the Bank and the authorities of the L.I.C. to ensure that whatever admissible and payable amount of group insurance of late Ram Karan Nayak is found payable must be paid to the petitioner within a period of three months from the date of receipt of this order. If for any reason such amount of group insurance is not found payable to the petitioner, the reasons thereof must be communicated to the petitioner by the authorities of the Bank within the same period of three months.

Let it be made clear that since this group insurance scheme was implemented by the Bank and the L.I.C. was made the agency by the Bank, the ultimate responsibility of payment of group insurance amount will lie on the Bank.

With the aforementioned observation and direction, this application is disposed of.
