2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 364/34 of the Indian Penal Code.

3. The sister of the informant was married with the petitioner. As the sister of the informant had no children out of her wedlock, the petitioner remarried with another lady. On 08.08.2021, the informant received an information that his sister is missing. It is alleged by the informant that the petitioner and in-laws of sister of the informant have killed her and disposed of her dead body.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner is the husband of the sister

Patna High Court CR. MISC. No.53556 of 2024(2) dt.28-08-2024 2/2 of the informant. He submits that the victim has herself appeared at Mahila P.S., Khagaria on 27.08.2021. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

5. Learned APP for the State opposes the prayer for bail submits that the victim in her statement recorded under Section 164 of the Cr.P.C. has supported the prosecution case.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Gogri P.S. Case No. 365 of 2021.

7. However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order.
