2. The petitioner has preferred this application for grant of regular bail in connection with S.Tr. No. 247/1995, 766/2023 arising out of Dumariya P.S. Case No. 10/1991 dated 10.03.1991 registered for the offences punishable u/s 147, 148, 149, 302, 380, 436, 323 and 341 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused persons along with unknown miscreants are alleged to have assaulted the informant and his family members and burnt his house. Further, they raised slogan of M.C.C. and stole household articles from the house of the informant.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with any anti-social activity nor he was an active member of any Naxal Group. There is general and omnibus allegation against the petitioner. Learned counsel has submitted that after release on bail, the petitioner went outside the State for earning his livelihood after giving instruction and paying the money to the advocate's clerk of court below to do the proper pairvy of the case, but he failed to do so, due to which his bail bond was cancelled on 14.11.2024 and N.B.W. of arrest was issued against the petitioner. It is further submitted that the petitioner has not intentionally misused the privilege of bail and the petitioner is 73 years old person. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 30.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner is the active member of Naxal Group.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond

No.63601 of 2025(3) dt.17-09-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sherghati, Gaya in connection with S.Tr. No. 247/1995, 766/2023 arising out of Dumariya P.S. Case No. 10/1991 dated 10.03.1991 with the conditions:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled. (ii). The petitioner is directed to co-operate the trial before the learned court concerned.
7. The application stands allowed.
