JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Petitioners apprehend their arrest in connection with Habibpur P.S. Case No. 55 of 2014 registered under Sections354(B), 379, 384 & other minor sections of the Indian Penal Code. The contention on behalf of the petitioners is that the wife of the petitioner No. 1 filed complaint case bearing Complaint Case No. 2432 of 2014 against the prosecution party on 22-11-2014 and in retaliation to the aforesaid complaint case, the informant lodged this case. It is further contended that there is land dispute between the parties and a Title Suit is subjudice and

Patna High Court Cr.Misc. No.10584 of 2015 (2) dt.19-03-2015 furthermore, a proceeding u/S 144 of the Cr. P.C. was also initiated between the parties.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let petitioners named above, in the event of their arrest or surrender within four weeks from today, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Habibpur P.S. Case No. 55 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
