23-05-2016 The petitioners, who are brothers, apprehend their arrest in relation to Sirdala P.S. Case No. 208 of 2015 registered under Sections 341, 323, 354(A), 504, 506/34 of the Indian Penal Code read with Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.

Learned counsel for the petitioners draws attention of this Court to the order passed on 12.04.2016 in Cr. Misc. No. 15095/2016 (Surendra Prasad and others Vs. State of Bihar), wherein two of the accused persons have already been granted bail in anticipation of arrest by this Court in relation to the same case. Learned

Patna High Court Cr.Misc. No.21912 of 2016 (2) dt.23-05-2016 2 / 2 counsel for the petitioners points out that prior to lodging of the present case on behalf of the accused persons, already a Sanha was lodged in the Police Station alleging false implication.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioners, namely, Durga Nand Prasad, Prithavi Raj Prasad and Pradhuman Prasad, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Nawada, in connection with Sirdala P.S. Case No. 208 of 2015, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
