This writ application has been filed by the petitioner without availing the statutory remedy of appeal. Petitioner is aggrieved by the order dated 29.5.2012 passed by the Sub Divisional Officer -cum - licensing authority, Kishanganj, as contained in Annexure 2, by which he has cancelled the PDS licence of the petitioner.
Learned counsel seeks leave to prefer appeal before the appellate authority.
Accordingly, this writ application is being disposed of granting liberty to the petitioner to prefer an appeal assailing
Patna High Court CWJC No.3727 of 2014 (2) dt.19-07-2016 2/2 the order of the licensing authority. If such appeal is filed within 30 days then let the same be considered and disposed of on its own merit and in accordance with law without raising the issue of delay/limitation.
