The petitioner apprehends his arrest in Salkhua (Banma Itahari) P.S. Case No. 264 of 2015 registered for the offences punishable under Sections 147, 148, 149, 504, 341, 323, 379 and 307 of the Indian Penal Code and under Section 27 of the Arms Act.
The informant alleged that the petitioner and others armed with different weapons and firearms came to her Darwaja. The accused persons started abusing her father-in-law. The petitioner is said to have fired, which passes touching the skin near the temple of the informant.
Learned counsel for the petitioner submits that there is case and counter case. The injury found on the person of the
Patna High Court Cr.Misc. No.22936 of 2016 (4) dt.03-08-2016 2/2 informant is simple in nature caused by hard and blunt object. Considering the facts aforesaid and the fact that there is very specific allegation against the petitioner that he made indiscriminate firing, I am not inclined to enlarge the petitioner above named on anticipatory bail in Salkhua (Banma Itahari) P.S. Case No. 264 of 2015, pending in the court of Additional Chief Judicial Magistrate 2nd, Saharsa. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) KKSINHA/- U T
