JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 12.09.2017 passed in Cr. Misc. No. 39412 of 2017 in connection with Begusarai Rail P.S. Case No. 09 of 2017 registered for the offences punishable under Section 20 and 22 of Narcotic Drugs and Psychotropic Substance Act, 1985. Submission of learned counsel for the petitioner that the co-accused from whom the recovery of 20 kg and odd ganja was recovered, has already been enlarged on bail by a coordinate Bench of this Court vide order dated 27.06.2018 passed in Cr. Misc. No. 26950 of 2018 and petitioner has been in judicial custody since 23.04.2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.42910 of 2018 (2) dt.18-07-2018 2/2 bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -I - cum-Special Judge, NDPS Act, Begusarai in connection with Begusarai Rail P.S. Case No. 09 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of her bail bonds.
