The petitioner seeks pre-arrest bail in connection with Forest Case No. 15 of 2016 registered under Sections 33, 41, 42 and 52 of the Forest Act.
It is contended by the learned counsel for the petitioner that the petitioner has been implicated merely on the basis of hearsay statement of Waliyan Rajbhar. Neither the vehicle of the petitioner was seized nor any incriminating article was recovered from his possession.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner.

No.21848 of 2016 (2) dt.25-05-2016 2 / 2 Be that as it may, regard being had to the facts and circumstances of the case as also the fact that the petitioner is reported to be a man of clean antecedent, in the event of arrest or surrender in the court below within six weeks from today, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Forest Case No. 15 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C.
