The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 188, 224, 225, 341, 323, 353, 355, 379/34 of the Indian Penal Code and section 47a of the Excise Act.
Prosecution case is that the petitioner being staff of licensee liquor shop was selling liquor on the dry day, declared by the district magistrate, when the raid was led and the petitioner was apprehended with some liquor, then the petitioner was released by the other accused persons forcibly. It is submitted by learned counsel for the petitioner that the petitioner has never been apprehended. The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.23813 of 2016 (2) dt.26-05-2016 2/2 consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sarairanjan P.S. Case No.75/2016, pending before the learned CJM, Samastipur. With the above observation, this application is, accordingly, disposed off.
