The petitioners apprehend their arrest in Brahmpur P.S. Case No.231 of 2019 registered under Sections 341, 323, 325, 308, 379, 506/34 of the Indian Penal Code. The informant, Saraswati Devi, named the petitioners and other accused persons and alleged that they forcibly entered into her house and assaulted the informant and her son. Ashok Kumar Ray, petitioner No.1 snatched chain made of gold. The learned counsel for the petitioners submits that petitioners are co-sharers of the informant and her husband. There is no specific allegation of assault against the petitioners.

Patna High Court CR. MISC. No.48928 of 2019(2) dt.06-08-2019 2/2 On account of land dispute, some scuffle took place. The injuries found on the persons of Saraswati Devi and her son, Abhay Kumar Rai are simple in nature.

Taking into consideration the fact that petitioners are co-sharers of the husband of the informant and the occurrence took place due to land dispute in which simple injuries are found on the persons of informant and her son, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S. Case No.231 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
