JUSTICE BIRENDRA KUMAR ORAL ORDER 31-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. The FIR for the offence under Section 379 of the Indian Penal Code is against unknown.

Submission is that on the confessional statement of co-accused Md. Zahid name of the petitioner has surfaced during investigation. However, nothing has been recovered from the possession of the petitioner and petitioner is in custody since 21.02.2018. Investigation of the case is already complete. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.44659 of 2018 (2) dt.31-07-2018 P2/ bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Terhagaachh P.S. Case No.41 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
