Petitioner seeks bail in a case registered for the offences punishable under Sections 414, 307, 506, 504/34 of the Indian Penal Code and Section 25(1-B)A, 26, 27, 35 of the Arms Act.
There is allegation of firing against the petitioner, however, no injury was caused.
Submission is that the informant claims to have identified the petitioner and there is no specific allegation of commission of any assault to anyone nor anything was recovered from possession of the petitioner nor he was apprehended from the spot.
Learned counsel for the informant opposed the
Patna High Court Cr.Misc. No.44713 of 2018 (2) dt.01-08-2018 2/2 prayer for bail.
Considering the nature of allegation and nature of material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Triveniganj Police Station Case No. 431 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
