Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown. The petitioner was remanded in this case from some other case on the confessional statement of co-accused Rahul Rao wherein name of the petitioner has also surfaced. Submission is that nothing incriminating has been recovered from possession of the petitioner. Investigation of the case is complete now.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.44723 of 2018 (2) dt.01-08-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Kotwali Police Station Case No. 130 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
