The petitioner seeks regular bail in connection with Paroo P.S. Case No. 377 of 2019, registered for the offence punishable under section 395 of the Indian Penal Code.
The allegation is regarding unknown miscreants having intercepted the vehicle of the informant, whereafter they are stated to have tied the eyes of the informant and his companions and upon leaving them in the chaur, the said unknown miscreants had fled away with the tobacco loaded vehicle of the informant.
The learned counsel for the petitioner has

No.60917 of 2021(2) dt.30-03-2022 2/3 submitted that the petitioner is innocent, has been falsely implicated in the present case and is languishing in custody since 01.07.2020. The learned counsel for the petitioner has further submitted that only after the petitioner was arrested in connection with one other case, he has been remanded in the present case without any evidence and in fact has got no complicity in the instant case. It is further submitted that the materials on record do not suggest the involvement of the petitioner in the alleged crime more so since prior to lodging of the present case and one other case from which he has been remanded in the present case, he was having a clean antecedent.
Per contra, the learned APP for the State, has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the parties and taking into account the materials available on record as also considering the fact that neither any T.I. Parade
Patna High Court CR. MISC. No.60917 of 2021(2) dt.30-03-2022 3/3 has been held so as to connect the petitioner with the alleged crime nor any recovery of the stolen vehicle has been made from the petitioner apart from the fact that prior to the present case and one other case in which he was arrested and then remanded in the present case, he was having a clean antecedent, I deem it fit and proper to admit the petitioner to the privilege of regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bailbonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- III (West), Muzaffarpur in connection with Paroo P.S. Case No. 377 of 2019.
